- Fam - 離婚: 不合理行為 | lawfirm-hk
哪些行為被法院視為不合理 , 所以這是離婚的理由之一 The most common examples of unreasonable behavior in divorce Grounds for Divorce Most Common Examples of Unreasonable Behavior in Divorce Examples of unreasonable behavior 1) Domestic Abuse 2) Emotional abuse 3) Family Disputes 4) Excessive use of gaming/social media 5) Debt/Financial Recklessness 6) Inappropriate relationships with others 7) Abusive, yelling, or demeaning 8) Lack of socializing together 9) Drunk 10) Lack of support What other behaviors are unreasonable behaviors? What else should I know about unreasonable behavior? Unreasonable conduct is one of the five available grounds for divorce. It is used in approximately 45% of all divorce applications[uk], making it the most commonly used reason. Use our list of examples of unreasonable conduct as a guide for drafting the details of your divorce petition. Of course, these examples need to be expanded further to provide the judge with complete context about the actions, the time period, and how they made you feel. If you want fast and reliable answers to your questions, please chat with us via live chat. Let's take a look at the 10 most common examples of unreasonable behavior. 1) Domestic Abuse In our research, we found that domestic abuse remains one of the most common behaviors mentioned in the divorce petitions we receive based on unreasonable behavior. If you are being abused then this is obviously grounds for divorce. Abuse can take many forms, so it should be possible to create a list of 4-5 behaviors from just this one action. Example of divorce petition: "On [insert date], the respondent physically abused the claimant, causing them to feel [insert emotion] 2) Emotional abuse Emotional abuse is more common than you might hope. We tend to find that this happens more in people with shorter marriages and younger people. Example of divorce petition: "On [insert date], the respondent physically abused the claimant, causing them to feel [insert emotion] 3) Family Disputes Domestic disputes are probably the most common example we see from clients. They happen for a variety of reasons, and they never make marriage easy. The most common disputes we see are when a spouse’s parents or siblings don’t get along with their husband or wife, making it difficult to socialize together. In this case, the misconduct could be unnecessary verbal abuse, reluctance to discuss the subject, or different types of abuse towards family members. Example of a divorce petition: "Since [insert date], the respondent has continued to be rude to my family, causing the petitioner to feel [insert emotion/feeling]. The respondent understands the petitioner's feelings, however, they remain fully I don't want to discuss this topic." 4) Excessive use of gaming/social media Gaming and social media addiction has become more common in recent years with the release of popular games and sites like Fortnite and TikTok. Addiction to anything can put a lot of pressure on the other person. Even 10 years ago, excessive gaming or social media use would never have been mentioned in divorce filings, but now they are surprisingly common. We've covered how Fortnite has been responsible for many divorces before, and Facebook's impact on marriages over the past 8 years. If your spouse is overly gaming or inattentive or passive while browsing social media, this could be the catalyst for a marriage breakdown. Example of a divorce petition: "The respondent often spends hours on the phone without speaking to the petitioner. This makes the petitioner feel [insert emotion/feeling]. Since [insert date], I have asked respondents to be more engaged and Respond, however, they continue to spend hours on the phone." 5) Debt/Financial Recklessness Some people just don't use their money wisely, which can lead to marital problems. In some marriages, one partner takes on debt without the other knowing. For example, this could be due to addiction, drug use or gambling. Being financially reckless when you're married can put a lot of stress on the other person because marital finances are shared. If one party to the marriage has to pay more due to the wrong money decision of the other party, disagreements are likely to arise. Example of divorce petition: "Defendant accumulated a huge debt without my knowledge. I discovered the debt on [insert date], and when face to face, Respondent agreed to reduce money for gambling and drinking. However, Respondent's debt Constantly increasing, which makes the applicant feel [insert emotion/feeling]. 6) Inappropriate relationships with others This is often called adultery. This is the act of one person having sex with another person of the opposite sex. An inappropriate relationship with another does not necessarily mean adultery has occurred, but, for some, it is enough. Using unreasonable behavior is your best bet if you can't continue marrying your spouse after becoming aware of their behavior. Example of a divorce petition: "I found in [insert date] that the respondent had an inappropriate relationship with another woman/man, which made the applicant feel [insert emotion/feeling]". 7) Abusive, yelling, or demeaning If your spouse abuses you multiple times, this can lead to the breakdown of your marriage. The same goes for yelling and/or belittling, as these types of behaviors can create differences between couples. Many times, these types of behaviors are combined with other examples of unreasonable behavior, such as excessive drinking, emotional abuse, etc. If these types of behaviors caused your marriage to break down, or if they were a contributing factor, they can be used for divorce. Example of divorce petition: "Respondent has frequently verbally abused the applicant, causing the applicant to feel [insert emotion/feeling]" Since [insert date], the respondent has continued this behavior after realizing how it made the applicant feel. 8) Lack of socializing together In a marriage, it's common for each partner to have an interest in different things, whether it's hobbies, socializing with friends or family, or possibly animals. If the spouses are socially separated on a regular basis, it can lead to the breakdown of the marriage, as one partner may feel alienated or neglected by the other. Example of a divorce petition: "The respondent has no interest in socializing with the applicant, and since [Date], has continued to play golf with his friends, causing the applicant to feel [insert emotion/feeling, eg, lonely, neglected] 9) Drunk It is fairly common for one party to be regularly drunk and behave inappropriately to the petitioner, but how sad the truth is. This appears to have accelerated even more during national lockdowns, as our research shows. We found that, often, excessive intoxication leads to name-calling, yelling, and demeaning, but of course, drunkenness is followed by a range of other behaviors. Example of a divorce petition: "Respondent has been drinking excessively since [insert date], which has resulted in verbal abuse and yelling that has made applicant feel [insert emotion/feeling]". 10) Lack of support Petitioners often cited their lack of support for things like housework and childcare as grounds for divorce. There are other types of lack of support such as emotional support, career support, etc. Often, a lack of support can lead to other problems in the marriage, such as disagreements, social separation, and even sleeping apart. If your marriage falls apart due to lack of spousal support for any reason, then you can use it to file for divorce. Example of a divorce petition: "The respondent 's failure to support me in household cleaning and child care made the respondent feel [insert emotion/feeling]". What other behaviors are unreasonable behaviors? Now, of course, there are a series of mild examples of why marriages break down, possibly...as unreasonable behavior: Respondents were more willing to spend time with pets than applicants. Respondents declined to discuss marital issues. The respondent did not give the applicant general support, such as with housework. The respondent worked long hours and was often away from home, making the applicant feel stressed and lonely. The defendant played video games for extended periods of time while leaving the petitioner alone. What else should I know about unreasonable behavior? There are some important things to know before filing for divorce based on your spouse's actions. If your circumstances permit, you should try to agree with your ex-partner on the reasons to avoid any unnecessary conflict. The details you draft in your divorce petition must be actions by your spouse (not your own) that caused the marriage to break down. In order for a judge to approve your divorce, it is recommended that you compile a list of 4-5 examples of misconduct. Unfortunately, under divorce law, to get a quick divorce you must claim that something happened in the marriage that caused the marriage to break down.
